The purpose of this document is to regulate the General Contracting Conditions of the online accommodation reservation services of EL RECHAYU S.L, (hereinafter “Hostal Barrera”), a Spanish company with address at c/ Atocha 96, 2º, 28012 Madrid, telephone 91 527 53 81, with tax identification number B-56942782 and registered in the Commercial Registry of Madrid, volume 46172, folio 160, sheet M-811130, 1st inscription.
The terms “you” and “user” are used here to refer to all individuals who for any reason access www.hostalbarrera.es (hereinafter, the website) or use the services provided on the portal. The use of these services will imply full and unreserved acceptance and the validity of each and every one of the General Contract Conditions. As a client, you declare that you are of legal age and have sufficient legal capacity to be bound by these General Contract Conditions when contracting with Hostal Barrera. Hostal Barrera informs that the procedures to obtain the provision of the services offered are those described in these General Contracting Conditions, as well as those other specific ones that are indicated on the screen during navigation, so that you declare that you know and accept said procedures as necessary to contract the services offered on the website.
Use of online accommodation reservation services
The purpose of online accommodation reservation services is to reserve a room at Hostal Barrera. The use of these services will imply full and unreserved acceptance and the validity of each and every one of these general conditions as well as the particular contracted conditions of the stay selected by the user.
After making an online reservation, the user will receive a confirmation email that will include their reservation locator number. This email serves as proof of your reservation and as confirmation of acceptance of the general and specific conditions.
Likewise, the user may receive an email to carry out, if desired, an online pre-check-in and thus expedite the procedures for entering the hostal upon arrival.
The user undertakes to use the services in a manner in accordance with the law, morality, good customs and public order, as well as with the provisions of these General Contracting Conditions. Consequently, you are obliged not to use the services for illegal purposes and/or contrary to what is established in these General Contracting Conditions, harmful to the rights and/or interests of third parties or that, in any way, may damage the services of the Hostal Barrera and/or its image. Hostal Barrera may, for greater agility and for the benefit of users, unilaterally modify, at any time and without prior notice, the online accommodation reservation services provided or the operating, technical and use conditions of said services.

The online accommodation reservation form will contain the details or particular conditions of the stay contracted by the user: check in and check out dates, meals, extra beds policy, cancellation policy, among others.
When making a search, the prices will be indicated per room and night, although the total price of the contracted stay together with the VAT information, other indirect tax or applicable tourist tax will be indicated in each case in the corresponding reservation form.
Reservations made through this website will be guaranteed by means of the credit card provided by the user in the form. Failure to show up on the day of check-in (“no show”) or cancellation after the deadline (less than 72 hours) will result in an automatic charge to the credit card for the amount corresponding to one night, as well as the cancellation of the reservation. Non-refundable rate applies full payment when receiving the confirmation, the amount payed for reservation is not refundable in case of cancellation. In case of “No-Show” total reservation amount will be charged. Modification of the General Contracting Conditions
Hostal Barrera reserves the right to modify unilaterally and without previous notice, any of the extremes included in the present General Contracting Conditions, in the way it deems convenient.

Likewise, in case of error in the publication of the price, the Hostal Barrera reserves the right to modify the reservation price and is exempt of any responsibility for such modification, only in the case that it has published an erroneous price produced by a technical and/or human error and as long as the error is accredited before the client.
Safeguarding of the General Terms and Conditions of Business
Should one of the provisions of these General Terms and Conditions be declared null and void or inoperative, the rest of the General Terms and Conditions shall be maintained in the agreed terms. Nothing in this contract shall in any way affect the mandatory consumer provisions. If you are not a consumer, you expressly waive your right of withdrawal.
Applicable Legislation and Competent Jurisdiction
These General Terms and Conditions are subject to Spanish law and any disputes arising from them shall be resolved before the Courts and Tribunals of the city of Madrid, Spain, which shall have exclusive and exclusive jurisdiction over any other jurisdiction. This shall be without prejudice to the jurisdiction of the Courts and Tribunals of the domicile of the consumer in the event that the user has the status of consumer and user as provided in Law 1/2007, which approves the revised text of the General Law for the Protection of Consumers and Users, as well as other complementary laws or regulations in force that replace it at any time.
